General conditions of sale

1. Purpose and scope

These General Terms and Conditions apply to any sale made via the coslys.fr website between COMPTOIR DES LYS company registered in the ANGERS RCS under the number 480 737 030 00043, whose head office is at CHOLET (49300), 4 rue de Blois, below the Seller, and any natural person wishing to purchase as a consumer, below the Customer. The validation of an order is an unqualified acceptance of these Terms and Conditions.

2. Products

The products proposed are those presented on the site, within the limits of available stocks. The descriptions (text, image, technical characteristics) are indicative and non-contractual. In case of unavailability, the customer will be informed and reimbursed or advised on an equivalent product.

3. Price and payment

Prices are shown in euros, including all taxes (including taxes), with precise shipping or eco-contribution charges. Payment methods accepted (e.g. credit card, transfer) are specified when ordering. Payment is due on the validation of the order and the transaction is final only after actual receipt.

4. Command

The Customer makes the order via the basket, validation and acceptance of the GTC via a mandatory box. The Seller reserves the right to cancel any order in the event of a dispute with a previous customer.

5. Delivery

Products purchased by the Customer will be delivered exclusively to metropolitan France (including Corsica) and Belgium.

5.1 – Purchases delivered to the delivery address indicated by the Customer

5.1.1 – Place and method of delivery

The Customer will be delivered to the delivery address indicated by him at the time of order registration.

However, COMPTOIR DES LYS reserves the right to refuse delivery in certain public places in cases where security of delivery is not ensured (hotels, schools, bars restaurants etc.). Indeed, it is impossible to guarantee the delivery of the parcel in its own hands to the consignee in these places. In this case, the delivery may be made pending at the post office at the choice of the Customer.

Delivery is by Colissimo. It can only occur once the order has been validated and the payment made in full. The bank payment centres concerned will therefore have given their payment agreement in advance.

The Customer will be notified by COMPTOIR DES LYS on the day of dispatch of the order. It is up to the Customer to take all measures so that the order can be received.

In case of an order with a delivery address different from the billing address, COMPTOIR DES LYS has the possibility to contact the person to receive the order.

The carrier will deliver the order to the Customer himself or to the third party, natural person designated by the Customer or to any authorized person, presenting the authority to accept the delivery of the order on behalf of the consignee (person at the same address as the Customer or the Designated Third Party).

The shipping costs will be borne by the Customer under the conditions set out herein.

When presenting the package(s) by the carrier, it is necessary to be present to allow delivery in the best possible conditions. The transport does not include the delivery to the floors which remains at the approval of the driver.

In the event of a delivery failure, the parcel will be deposited at the post office on which the delivery address depends with a delay of fifteen (15) working days to recover the parcel.

After this period, COMPTOIR DES LYS will be entitled to cancel the order because of the Customer. Products ordered, undelivered and not withdrawn will be returned for failure to deliver by the Customer.

The costs associated with the failure of delivery by the Customer will be borne by the Customer, namely: the costs associated with sending and returning the package.

In case of cancellation of the order by the Customer, COMPTOIR DES LYS will proceed, within fourteen (14) days from the cancellation to the refund of the price of the order less the costs related to the failure of the delivery referred to above, unless the right of withdrawal is implemented by the Customer.

The Customer's Delivery is made on presentation of the documents necessary to identify the Customer or designated recipient (identity card in particular).

5.1.2 - Deadlines for processing orders before shipment

When all ordered items are available, the processing of orders takes place three (3) working days after the date of the order registration.

When one or more items in the order are being procured, the logistics processing time of the order for its shipment will start as soon as the command is complete.

5.1.3 - Routing time after shipment

Once the order is shipped, the purchases delivered at home will be delivered by the Post (Colissimo service) within an average time of two (2) to five (5) days worked at the address indicated by the client during the composition of its order.

Unless otherwise stipulated in the order and accepted by the client during the validation of the order, the products shall be delivered to the client within the abovementioned time required for the processing and shipment of the order. In the case of an order with products not available in stock requiring a procurement period, the delivery will occur no later than 30 days after the conclusion and validation of the sales contract. In any event, in accordance with the provisions of Article L216-2 of the Consumer Code, in the event of delivery delay of more than 7 days in relation to the delivery time indicated in the conclusion of the contract, the Customer may cancel the order, by registered letter with request for receipt, except force majeure.

The provisions of Article L216-2 of the Consumer Code do not apply in the event of a delivery delay due to the client and in particular in the event that the client or third party designated by him would not be available to receive the delivery or in the event that the client would not proceed to Withdrawal of the order within the time of provision of the product. Similarly, the provisions of Article L216-2 of the Consumer Code do not apply in the event of a delay related to an insurmountable and unpredictable event due to a third party to the contract that would tend to hinder, delay or prevent the delivery of the customer ordered.

5.2 - Transfer of risks / anomalies during delivery:

The transfer of risks will take place on delivery, at the time of the delivery of the products to the customer who will assume alone, after this remission all the risks (including loss, theft or deterioration) of the delivered products.

Any risk of loss or damage to the property is transferred to the Customer at the time when the latter or a third party designated by him, and other than the carrier proposed by Lys Counter, physically takes possession of these goods.

Upon delivery of the designated or ability to order, the customer or the person is required to verify and accurately check the status and compliance of the products delivered to the order.

If, during the delivery, the external appearance of the package appears damaged or damaged, the customer or the recipient of the products shall carry out his opening in the presence of the carrier or the commercial counselorature of the Lys, in order to check the status of the product (s).

In the event of an anomaly found (missing products, damaged or broken in particular), the customer will have to refuse the receipt of the product and indicate on the correct or the delivery receipt "Refusal for damage".

In the case of non-compliance of products with the order recorded during the delivery, in order to allow the processing of the customer's claim as soon as possible and conditions, the customer will have to issue all the detailed reserves useful on the delivery receipt.

Any claim relating to an apparent defect or damage when delivering a product, must, to be valid for the carrier, be sent within 48 hours from the receipt of the goods, by e-mail or registered mail addressed to the service Customer of the site.

In cases of a refusal of delivery for reasons referred to above, the customer may request a new delivery or the cancellation of his order with the Lys Counter.

6. Retraction / Right of return

In accordance with the law, the customer has a retraction right of 14 days from the receipt of the product. The refund and return arrangements must be explicit (return address, any costs to the customer's charge, repayment period).

7. Legal guarantees

Apply the legal warranty of compliance (Articles L.217-4 et seq. Of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. Of the Civil Code). The modalities and conditions of implementation must be detailed.

8. Liability and force majeure

The liability of the seller can only be engaged in proven fault. In case of force majeure (disaster, strike, server failure ...), its responsibility is unobstructed.

9. Personal data

In accordance with RGDP, the data collected is required for the processing of orders. The customer is informed of his rights (rectification, deletion, access, limitation, portability) and the shelf life. The privacy policy must be accessible and detailed.

10. Mediation and dispute settlement

In case of conflict, the customer may use a consumer mediator for free whose contact details should be mentioned. In the absence of agreement, competence will be attributed to the competent French courts.

11. Intellectual property

Any reproduction and / or full or partial representation, use, adaptation or modification, site or any of any elements that compose it (drawings, logos, models, photographs, marks, etc ...) on any medium whatsoever, and in any form whatsoever, at Other purposes and including commercial purposes is expressly prohibited.

The site is an inspiration protected by the law of intellectual property.

Any reproduction and / or representation of the site or any of any of the elements that compose it should be subject to an express and prior authorization of Lys Counter. Similarly, the creation of hypertext links to the site can only be achieved with the written and prior agreement of the Lys counter.

The coslys brand cited in the site is a registered trademark and therefore protected, property of nature and strategy SAS.

12. Change of GTC

Given the possible evolutions of the site, Lys Counter reserves the right to modify these conditions at any time. The new general conditions of sale will, if necessary, be brought to the attention of the client and will be applicable to the only sales made after the amendment.
